Terms and conditions
These terms cover using aswconvert.com and working with us. “We” and “us” means ASW Convert Ltd, a company registered in England and Wales, company number 17543803. “You” means the person or business using the site or working with us. Questions about these terms: sales@aswconvert.com.
1. Using this website
- The website tells you about our services. We try to keep it accurate and up to date, but it isn't a promise or an offer: the details of any work are set out in the written quote we send you.
- The examples of our work open real websites inside this one so you can try them. Some are concepts we designed to show a business what we could do for them, and are labelled as such; they may not be that business's current website. Forms and bookings inside those examples are demos and don't send anything to the business shown.
- Everything on this site, including its design, text, films and code, belongs to us or the people we license it from. Please don't copy it without asking.
- We link to other websites we don't control and aren't responsible for their content.
2. Calls and free concepts
- Booking a call or asking for a free concept is free, and doesn't commit you to anything.
- A free concept is a design we make to show you our ideas. It stays ours until you engage us to build it. You're welcome to look at it and share it within your business, but please don't have it built or copied elsewhere.
3. Quotes and agreeing the work
- Before we start, we send you a written quote setting out what we'll do, the price and the timings. Work goes ahead once you accept it in writing (an email is fine) and pay any deposit it asks for.
- If we agree a separate contract or proposal for your project, that comes first, and these terms fill in anything it doesn't cover.
- Changes you ask for that are outside the agreed work are quoted separately before we do them. The quote says how many rounds of revisions are included.
4. Payment
- Prices are fixed as quoted. Invoices are due by the date shown on them.
- Some services have running costs, such as hosting, domains, AI voice minutes or other subscriptions. We tell you about these before you agree, and they're charged as set out in your quote.
- If a business invoice is paid late, we may charge interest and recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998, and pause work until it's paid.
5. Your part
- You'll send us what we need to do the work (such as text, photos, logos, access and feedback) in good time. Delays on your side may move the timings.
- You confirm that you have the right to use anything you send us, and that the facts and claims you ask us to publish are true. Please check everything before it goes live.
6. Who owns the work
- Once you've paid in full, you own the finished work we made for you, such as your website's design and content, and your films.
- We keep ownership of our own tools, code libraries and methods, and give you a permanent licence to use the parts of them built into your work. Third-party items (such as fonts, stock images, music or plugins) are covered by their own licences, which we set out before we use them.
- We may show the work in our portfolio and on this website. Tell us if you'd rather we didn't.
7. AI-generated content
Some of our work uses AI tools, for example AI video, AI voice agents or draft copy. We label AI-generated media, never present synthetic people as real customers, and check the work before handing it over, but you should review it too before publishing, as AI can make mistakes. An AI voice agent tells callers it's an AI assistant.
8. Cancelling
- Businesses: you can end a project by telling us in writing. You pay for the work done up to that point and any costs we can't get back. Deposits cover work already started and aren't refundable unless your quote says otherwise.
- Consumers: if you're buying as an individual rather than for a business, you have 14 days after accepting our quote to cancel under the Consumer Contracts Regulations 2013. If you ask us to start within those 14 days and then cancel, you pay for the work done up to then.
- We can end a project if you don't pay or don't provide what we need, after telling you and giving you a fair chance to put it right.
9. Our responsibility to you
- We'll carry out the work with reasonable care and skill. If something we made isn't as agreed, tell us and we'll put it right.
- For business clients, we aren't responsible for indirect losses, such as lost profits, lost business or lost data, and our total liability for a project is limited to the amount you paid us for it.
- We aren't responsible for services run by others, such as hosting providers, domain registrars, payment providers, social media platforms or AI providers, or for problems caused by changes someone else makes to your website or accounts.
- Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud, and nothing affects your legal rights as a consumer.
10. Complaints
If you're unhappy with anything we've done, email sales@aswconvert.com. We'll reply within 5 working days and do our best to put it right.
11. General
- We may update these terms. The version that applies to your project is the one in place when you accepted your quote.
- How we handle personal information is explained in our privacy policy.
- These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute.
